1 Scope of this policy

This policy applies to material displayed, hosted or made available through Biluxury Store, including product images, written content, reviews and customer-submitted material where applicable.

We may remove or disable access to material when we receive a substantially compliant copyright-infringement notice or otherwise determine that action is appropriate.

This process is intended for copyright complaints. Trademark, privacy, counterfeit-product or other legal complaints should be clearly identified when contacting us.

2 Submitting a copyright-infringement notice

If you believe that material available through our website infringes a copyright that you own or are authorized to represent, send a written notification to our designated Copyright Agent.

Your notification should contain substantially all of the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
  2. Identification of the copyrighted work claimed to have been infringed. For multiple works on the same website, you may provide a representative list.
  3. Identification of the material claimed to be infringing and information reasonably sufficient for us to locate it, preferably including the exact page URL.
  4. Your full name, mailing address, telephone number and email address so that we can contact you.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner’s behalf.

Before submitting a notice

Please consider whether the disputed use may be authorized by a license, permission, fair use or another legal exception. Notices should be submitted only by the copyright owner or an authorized representative.

3 How we respond to notices

1 Review

We review the notice to determine whether it contains the required information.

2 Action

When appropriate, we may remove or disable access to the identified material.

3 Notification

Where applicable, we may notify the person who provided or posted the affected material.

A notice that does not contain sufficient information may delay our review. We may contact the sender to request clarification or additional details.

Removal or disabling of material does not constitute a final legal determination regarding copyright ownership or infringement.

4 Submitting a counter-notification

If material you submitted was removed or disabled because of a copyright notice and you believe the removal resulted from a mistake or misidentification, you may send a written counter-notification to our Copyright Agent.

Your counter-notification should contain substantially all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled because of mistake or misidentification.
  4. Your full name, mailing address and telephone number.
  5. A statement consenting to the jurisdiction of the appropriate United States Federal District Court. If your address is outside the United States, the statement must consent to jurisdiction in a judicial district where the service provider may be found.
  6. A statement that you will accept service of process from the person who submitted the original infringement notice or that person’s authorized agent.

Send the completed counter-notification to the same designated Copyright Agent listed above.

5 What happens after a counter-notification

When we receive a substantially compliant counter-notification, we may provide a copy to the person who submitted the original infringement notice.

Where the statutory counter-notification process applies, the removed material may be restored no earlier than 10 business days and generally no later than 14 business days after receipt of the counter-notification.

The material will not be restored through this process if the original claimant informs us that a court action has been filed seeking an order to prevent the allegedly infringing activity.

6 Repeat infringement

Where customer accounts, reviews, uploads or other user-submitted content are supported, we may restrict or terminate accounts of users who repeatedly infringe intellectual property rights.

We may also remove content, restrict website features or take other appropriate action based on the circumstances of each case.

7 Misrepresentations and abuse

Copyright notices and counter-notifications are legal communications. A person who knowingly makes a material misrepresentation that content is infringing or was improperly removed may be responsible for resulting damages, costs and legal fees.

We reserve the right to reject incomplete, fraudulent, abusive or unrelated submissions and to request additional information when reasonably necessary.

8 Policy updates

We may update this policy periodically to reflect changes to our services, procedures or legal obligations.

The revised version will be published on this page with an updated “Last updated” date. Your use of the website after an update is subject to the revised policy.
